Dinner, Not Art. ("Program") is offered by Kraft Foods Group, Inc. ("Kraft"). This Program will enable you to create macaroni artwork using the tools provided, either via www.DinnerNotArt.com or the Dinner, Not Art. application for iPad^®. By participating in the Program, you agree to abide by these Submission Terms and decisions of Kraft and its designees, which shall be final and binding in all respects relating to this Program.

WHO CAN PARTICIPATE: You must be at least 18 years of age and a legal resident of the fifty (50) United States or the District of Columbia. Program is void where prohibited by law and subject to all applicable federal, state and local laws.

MACARONI MASTERPIECE GALLERY: Kraft will create a gallery ("Gallery") of artwork submitted as part of this Program. Upon completing your artwork, you will have the opportunity to submit your artwork and your name for consideration to be a part of the Gallery. Making a submission as part of this Program does not guarantee that your artwork will be used in the Gallery. All artwork will be selected by Kraft in its sole and absolute discretion. If Kraft selects your artwork for use as part of the Gallery, Kraft may decide to only use part or portions of your artwork. Also Kraft shall have the right to use your name and/or Facebook handle in connection with your artwork in the Gallery. For any communication related to this Program, including but not limited to confirmation of submission or selection, you will be contacted using the information provided at time of submission. Please understand that you will have no approvals over the final artwork displayed in the Gallery and the use of your name and/or Facebook handle in connection therewith. Kraft does not guarantee that all artwork initially selected for use in the Gallery will ultimately appear as part of the Gallery. Artwork must be your own original work and be in keeping with Kraft's image. Kraft reserves the right to remove any artwork from the Gallery at any time for any reason.

GRANT OF RIGHTS TO ARTWORK: By submitting artwork, you agree and hereby grant to Kraft and its designees, successors, licensees and assigns an unlimited, perpetual, irrevocable, assignable, royalty-free, fully paid-up license to reproduce, distribute, create derivative works of, edit, alter, display, exhibit, combine with other materials, exploit and otherwise use the artwork, and all elements embodied therein, and to use your name and/or Facebook handle in connection with the artwork, in whole or in part, in any manner and in any and all media now known or hereafter devised (including , without limitation, on Kraft’s website and social media pages such as Facebook, Pinterest and Twitter) throughout the universe for any purpose whatsoever, including, without limitation, for commercial purposes, without compensation or notification to, or permission from, entrant or any third party. You agree that Released Parties (as defined below) are not responsible for any unauthorized use of artwork by third parties. Released Parties do not guarantee use of any artwork.

GENERAL CONDITIONS: By submitting artwork, you agree (a) to release, discharge, hold harmless and indemnify Kraft, Apple, Inc., Crispin Porter & Bogusky, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, "Released Parties") from any and all injuries, liability, losses and damages of any kind (including, without limitation, arising from claims based upon invasion of privacy, defamation, or right of publicity) to persons, including death, or property resulting, in whole or in part, directly or indirectly, from your participation in the Program (including, without limitation, if your artwork is displayed in the Gallery) and/or the use of any artwork in any manner by Kraft or any other Released Party; and (b) to the use by Kraft and its designees of your name, Facebook handle, city and state of residence, image and/or likeness for advertising, publicity, promotional and trade purposes in any and all media, now or hereafter known, in any manner, worldwide in perpetuity, without compensation (unless prohibited by law) or additional consents from you or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled artwork; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program, the operation of the Program or in any Program-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Program or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Program or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Submission Terms, as solely determined by Kraft, will be disqualified. Kraft reserves the right at its sole discretion to suspend, modify or terminate the Program at any time and for any reason. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, KRAFT RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
